Terms of Service

These Terms of Service (hereinafter "Terms") set forth the conditions of use for this application "TestLog" provided by Akira Kawata (hereinafter "Operator"). By downloading and using this application, User agrees to these Terms.

Article 1 (Application)

These Terms set forth the conditions of use for this application and shall apply between the User and the Operator. At the time of downloading, installing, or using this application, the User shall be deemed to have agreed to all the provisions of these Terms.

This application is provided free of charge and may generate revenue through ad distribution. If the User is under 13 years of age, they cannot use this application.

Article 2 (Changes to Terms)

The Operator may change these Terms as necessary. The modified Terms shall become effective from the time they are posted on this application or website.

If the User continues to use this application after the modification, the User shall be deemed to have agreed to the modified Terms. In the event of significant changes, the Operator may notify in advance via in-app notifications.

Article 3 (License)

The Operator grants the User a non-exclusive, non-transferable license to use this application, subject to compliance with these Terms.

The User is prohibited from engaging in the following acts:

  • Reverse engineering, decompiling, or disassembling this application
  • Attempting to extract the source code of this application
  • Copying, modifying, translating, adapting, or creating derivative works of this application
  • Lending, selling, reselling, or distributing this application
  • Sub-licensing or transferring any or all of this application
  • Giving a third party the right to use this application in an unlimited manner

Article 4 (Prohibited Acts)

The User shall not engage in the following acts:

  • Acts that violate laws and regulations or public order and morals
  • Acts that infringe on the rights of the Operator or third parties (intellectual property rights, portrait rights, reputation rights, etc.)
  • Sending harmful programs, scripts, or data
  • Interfering with, modifying, or destroying the functions of this application
  • Registering or providing false information
  • Any other acts deemed inappropriate by the Operator

If the User violates this Article, the Operator may suspend or limit service provision without prior notice.

Article 5 (Intellectual Property Rights)

Copyright, trademark, patent rights, utility model rights, design rights, and other intellectual property rights related to this application belong to the Operator or the rightful owner.

The right to use this application granted based on these Terms does not transfer ownership of these intellectual property rights. The User cannot use these intellectual property rights without the prior written consent of the Operator.

Article 6 (Privacy and Data)

The Operator respects the privacy of Users and complies with the Personal Information Protection Act and related laws and regulations. The type of information collected, purpose of use, and provision to third parties by the Operator shall follow the "Privacy Policy" separately prescribed.

The User's test records, goal settings, and other data are stored on the User's device (local storage) and are not uploaded to cloud servers. Unless the Operator has intentional or gross negligence, the Operator shall not be liable for any loss or damage to data collected through the use of this application, even if it is lost or missing due to fire, earthquake, or other natural disasters, or causes beyond the Operator's control.

Article 7 (Disclaimer of Warranty)

This application is provided "AS IS" without any warranties of any kind.

The Operator makes no warranties, express or implied, regarding the following matters:

  • Proper operation, error-free operation, or absence of defects in this application
  • Accuracy, completeness, or reliability of the content of this application
  • Usefulness or fitness for purpose of results obtained from this application
  • That this application meets the User's requirements
  • That this application is free of viruses or other harmful components

Article 8 (Limitation of Liability)

The Operator shall not be liable for any damages arising from the use of this application (direct or indirect damages, loss of profits, loss of data, business interruption, etc.), except in cases where the Operator has intentional or gross negligence.

If any provision of these Terms is deemed invalid, the remaining provisions of these Terms shall continue to be valid.

Article 9 (Termination)

The User may uninstall or discontinue use of this application at any time. When this application is uninstalled, all data stored on the device will be deleted.

The Operator may terminate the provision of this application at any time without prior notice if deemed necessary. However, even in such cases, the Operator assumes no liability to the User.

Article 10 (Governing Law and Jurisdiction)

Japanese law shall be the governing law for disputes related to these Terms and this application. Tokyo District Court shall be the exclusive agreed jurisdiction of first instance for disputes arising from these Terms and this application.

Supplementary Provisions

These Terms of Service shall take effect from March 15, 2026.
